1. About these terms

Trunish ERP is the business system of Trunish Lifescience Private Limited ("Trunish", "we", "us"), with its customer portal. These terms apply to everyone who uses it: our staff, consultants we invite, and the people at our customers who use the portal ("you").

By signing in you accept these terms. They sit alongside your employment or consultancy contract, any confidentiality agreement you signed, and, for portal users, the commercial contract between your company and Trunish. Where those say something different, they take precedence.

2. Who may use the ERP

  • Only people Trunish has given an account to may use the ERP, and only for Trunish's business or, in the portal, their own company's dealings with Trunish.
  • What you can see and do is set by your role. Having a link to a page does not give you the right to open it.
  • Kiosks and TV displays are set up by Trunish and are for use at our premises only.

3. Your account and PIN

  • Your account is personal. Do not share your username, PIN, kiosk PIN, ID card or portal sign-in codes, and never sign in as someone else.
  • Change a PIN you were given the first time you sign in, and choose one others cannot guess. Trunish staff will never ask for your PIN.
  • Sign out on shared devices. If you think someone knows your PIN or has used your account, change it and tell an administrator straight away.
  • What is done under your account is recorded as done by you, in the audit trail.

4. Acceptable use

Use the ERP honestly and only for your work. In particular, do not:

  • try to see records, fields or departments your role does not give you, or get round any check, limit or approval;
  • enter records you know to be false, back-date them to mislead, or approve your own work where the ERP asks for a second person;
  • probe, scan or test the ERP's security, overload it, or access it with scripts or automated tools without written permission;
  • upload anything harmful or unlawful, or anything you have no right to share;
  • send customers or suppliers messages they have not agreed to receive, or use the ERP's contacts for anything other than Trunish's business;
  • accept an AI suggestion without checking it: you are responsible for what you accept.

5. Confidentiality

Everything in the ERP is confidential to Trunish and the people it concerns: production formulas, prices and costs, customer and supplier details, quality and regulatory records, staff and payroll records, and our business plans.

  • Use it only for your work and only as far as your work needs (need-to-know).
  • Do not copy, download, photograph, forward or discuss it outside Trunish except as your work requires.
  • Production formulas are the most sensitive information we hold. Every view is recorded. Do not copy them or take them off the system.
  • Your duty of confidentiality continues after your access ends.

6. The customer portal

  • The portal shows information about your own company's orders, artwork, invoices, statements and documents, for your company's use only.
  • Certificates of analysis, label formulas, artwork, invoices and other documents in the portal remain subject to the commercial contract between your company and Trunish. Showing them in the portal does not change that contract or add any warranty.
  • Order status and dates are our best information at the time and may change.
  • If you ever see information about another customer, do not use or share it, and tell us at once.
  • Your company should tell us when someone who uses the portal leaves, so we can remove their access.

7. Personal data

How we handle personal data, including yours, is set out in the privacy policy. If your work involves other people's personal data, handle it only as that policy and your role allow.

8. Availability

We work to keep the ERP available, accurate and backed up, but we do not promise that it will be uninterrupted, error-free or available at any particular time. It may be unavailable for maintenance, updates or reasons outside our control, such as failures at our hosting or messaging providers. As far as the law allows, the ERP is provided as it is, without warranties beyond those the law requires.

9. Limitation of liability

As far as the law allows, Trunish is not liable for any indirect or consequential loss, or for loss of profit, business or data, arising from use of the ERP or the portal or from its being unavailable.

Nothing in these terms limits liability that cannot be limited under Indian law, or changes what your employment contract or your company's commercial contract with Trunish provides.

10. Suspension and removal of access

  • Trunish may suspend, limit or remove your access at any time, for example when you change role or leave, when your company's dealings end, or to protect the ERP or its data.
  • We may do so without notice where we suspect misuse or a breach of these terms.
  • When your access ends, return or delete any company information you hold outside the ERP, unless the law requires you to keep it.
  • Records you made stay in the ERP, with your name, as part of Trunish's business records.

11. Intellectual property

The ERP, its design and content, and Trunish's formulas, documents, names and logo belong to Trunish or its licensors. You receive only the right to use the ERP as these terms allow; nothing else is transferred to you.

Documents and information your company provides remain your company's. You allow Trunish to use them as needed for our dealings with you. Other names and marks, such as Google, Gmail, WhatsApp and Cloudflare, belong to their owners.

12. Governing law and courts

These terms are governed by the laws of India. The courts at Umra Gam, Gujarat have exclusive jurisdiction over any dispute arising from them, subject to any dispute resolution clause in your employment contract or your company's commercial contract with Trunish.

13. Changes to these terms

We may update these terms when the ERP or the law changes. The date at the top shows when they last changed. For significant changes we will tell users in the ERP or by email; using the ERP after a change means you accept the new terms.
